Dependent child visas
Children of British citizens, people present and settled in the United Kingdom (people with indefinite leave to remain) and some people with limited leave to remain, including refugees, can apply to join their parent(s) in the United Kingdom (children of refugees who were conceived before the refugee left their home country can apply for refugee family reunion).
The rules are different depending on whether the parent(s) of the child are British citizens, settled or have limited leave to remain in the United Kingdom. Where both parents, or the only parent with responsibility for the child, is British or settled in the UK the application will be made under Part 8 of the Immigration Rules. Where one parent has, or is applying for, limited leave under Appendix FM the child must also apply under Appendix FM.
There are common requirements for both types of application:
- The child must be under 18;
- The child must not be leading an independent life;
- The child must not be married or in a civil partnership;
- The child must not have formed an independent family unit;
- The child must be adequately accommodated by the parent in the UK
There are different ‘financial requirements’ depending on which type of application you must make. There are also specific requirements about the relationship between the child and the UK based parent(s) which must be met.
